UNDR Terms of Service

UNDR is a real estate underwriting analysis app ("UNDR," "we," "us"). By creating an account or using the app, you agree to these Terms of Service and to the Privacy Policy. If you do not agree, do not use UNDR.

1. What UNDR is

UNDR is decision-support software. It gathers public-record and provider data about a property, lets you enter your own numbers and financing, and runs deterministic real estate calculations to produce an analytical "underwrite," a deal sheet, and supporting figures. It is a tool for your own analysis, nothing more.

2. What UNDR is not, and does not cover

UNDR is not, and does not act as, any of the following, and nothing in the app should be read as a service provided by any of them:

• an insurance underwriter, and it does not underwrite, bind, quote, or provide insurance of any kind;
• a broker, broker-dealer, real estate broker or agent, mortgage broker, or lender;
• an investment adviser, financial adviser or planner, appraiser, accountant, attorney, or tax adviser.

Nothing in UNDR is investment, financial, legal, tax, accounting, appraisal, or insurance advice, an appraisal or valuation, or a recommendation, solicitation, or offer to buy, sell, finance, insure, or hold any property, security, or other asset. Using UNDR does not create any professional, advisory, fiduciary, agency, or client relationship between you and UNDR. Consult a qualified, licensed professional before acting on anything you see in the app.

The words "underwrite" and "underwriting," and the phrase "Underwrite anything," refer only to UNDR's analytical modeling of real estate deals. They do not mean UNDR performs financial-institution, insurance, or securities underwriting of any kind, and they do not imply any professional service or guarantee.

3. Coverage is broad, not universal

"Underwrite anything" describes the breadth of analysis UNDR aims to support; it is not a promise that every property is covered or that any result is available, complete, or correct. UNDR relies on third-party data that covers the majority of real estate parcels in the United States, but not all of them, and not every jurisdiction. For some properties, data may be missing, delayed, partial, or inaccurate, and UNDR may be unable to produce a result at all. UNDR is intended for real estate in the United States.

4. The numbers are estimates. You must verify them.

Every figure UNDR shows, including property facts, ownership, taxes, comparable sales and rents, values, costs, financing terms, and every computed metric, is an estimate assembled from third-party public-record and provider data and from the inputs you enter. This data can be incomplete, out of date, wrong, or unavailable, and the calculations depend entirely on the accuracy of those inputs. An "underwrite" in UNDR is a snapshot as of the moment it is generated, not a verified appraisal and not a guarantee of value, rent, cost, return, or outcome.

You are solely responsible for independently verifying every figure, assumption, and result against original sources before relying on it or making any decision, offer, purchase, sale, financing, or other commitment. Do not use UNDR as your only source. Any decision you make using UNDR is your decision and your responsibility.

5. No warranty

UNDR IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE APP OR ITS DATA WILL BE ACCURATE, COMPLETE, CURRENT, RELIABLE, UNINTERRUPTED, OR ERROR-FREE. YOU USE UNDR AT YOUR OWN RISK.

6. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, UNDR, ITS OWNERS, AND ITS DATA AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST OPPORTUNITIES, LOST DATA, OR LOSSES ON ANY PROPERTY, INVESTMENT, OR TRANSACTION, ARISING OUT OF OR RELATING TO YOUR USE OF, OR RELIANCE ON, UNDR OR ANY FIGURE OR RESULT IT PRODUCES, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO UNDR WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US FOR THE APP IN THE TWELVE MONTHS BEFORE THE CLAIM OR ONE HUNDRED U.S. DOLLARS (US$100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you; where a limitation is not permitted, our liability is limited to the least the law allows.

7. Your responsibilities

You agree to use UNDR only for lawful purposes and your own real estate analysis, to be at least 18 years old, to keep your account secure, and to verify every figure before acting. You are responsible for your decisions and for complying with all laws that apply to your real estate, financing, and investment activity.

8. Third-party data and billing

Property data comes from licensed third-party providers and is subject to their accuracy and availability; we do not control it. Subscriptions and payments run entirely through the Apple App Store or Google Play under their terms; we never see or store your card details.

9. Indemnification

To the extent permitted by law, you agree to indemnify and hold UNDR and its owners harmless from any claims, losses, or expenses arising out of your use of the app, your reliance on any figure or result, your decisions, or your breach of these Terms.

10. Changes

We may update these Terms from time to time. Continued use of UNDR after an update means you accept the revised Terms. The "Effective" date above shows when the current version took effect.

11. Governing law

These Terms are governed by the laws of the State of Wyoming and applicable United States federal law, without regard to conflict-of-laws rules. UNDR is operated by a company organized in Wyoming. Any dispute relating to these Terms or to UNDR will be brought exclusively in the state or federal courts located in Wyoming, and you consent to the personal jurisdiction of those courts.
